NEW YORK IS A NO-FAULT DIVORCE STATE
You Generally Do Not Need to Prove Misconduct
New York permits divorce based on the irretrievable breakdown of the marriage for at least six months.
This is the ground most commonly associated with a New York no-fault divorce.
It means a spouse generally does not need to prove adultery, abandonment, cruelty, or other marital misconduct simply to end the marriage.
Before the Judgment of Divorce can be granted, however, the economic and parenting issues that apply to the marriage must also be resolved.
DOES NEW YORK STILL HAVE FAULT-BASED DIVORCE?
Yes.
New York law continues to recognize several traditional grounds for divorce in addition to irretrievable breakdown.
Depending on the circumstances, those grounds may include:
- Cruel and inhuman treatment
- Abandonment
- Imprisonment
- Adultery
- Living separate and apart pursuant to a qualifying separation judgment or agreement
The existence of a fault ground does not necessarily mean that alleging fault will improve the financial outcome of the case.

NEW YORK RESIDENCY REQUIREMENTS
Can You File for Divorce in New York?
Before New York Supreme Court can grant a divorce, the case must satisfy one of the residency pathways under New York Domestic Relations Law.
Depending on the facts, this can involve either a one-year or two-year residency requirement.

- How long either spouse has lived in New York

IS THERE A WAITING PERIOD FOR DIVORCE IN NEW YORK?
There Is No Universal Post-Filing Waiting Period
New York does not impose a general rule requiring every divorcing couple to wait 30, 60, or 90 days after filing before the divorce can be finalized.
That does not mean every divorce is immediate.
Procedural timing still matters.

New York divorce papers generally refer to the spouses as:
Plaintiff
The spouse who starts the divorce action.
Defendant
The other spouse.
These labels do not determine who has greater rights to property, custody, support, or any other issue.
Being the Plaintiff simply means that spouse commenced the action.
HOW PROPERTY IS DIVIDED IN NEW YORK
New York Uses Equitable Distribution
New York is not a community-property state.
